BREAKING NEWS: Music Modernization Act Of 2017 Introduced

 

Congressmen Doug Collins (R-GA) and Hakeem Jeffries (D-NY) will today (Dec. 21) introduce “The Music Modernization Act Of 2017” (HR 4706), legislation designed to improve songwriter royalty rates from digital streaming companies while making the music licensing process more efficient.

“This will be the first significant copyright legislation for songwriters in over 20 years,” says Nashville Songwriters Association International (NSAI) Executive Director Bart Herbison.

The bill instructs the Copyright Royalty Board (CRB) to utilize the “willing-seller, willing-buyer” rate standard when setting songwriters’ mechanical royalties. It further establishes that there is a mechanical royalty payment due to songwriters from subscription music services, something that has been subject to recent court challenges.

U.S. Senator Lamar Alexander (R-Tenn.) says, “Songwriters are the lifeblood of Music City, and their paychecks ought to be based on the fair market value of their songs – so that when they write a hit heard around the world, you can see it in their billfolds,” Alexander said. “We intend to introduce legislation that we have been working on for months to help songwriters receive fair market compensation early next year, and we will be including in our legislation many of the same provisions that were in the House bill introduced today.” Tennessee Senator Lamar Alexander and Utah Senator Orrin Hatch were noted as guiding forces throughout this process, years in the making. A Senate version of the legislation will be introduced in early 2018.

“This legislation has been years in the making, represents compromises with digital streaming companies and reflects substantial progress in the way digital mechanical royalties for songwriters are determined,” said NSAI President Steve Bogard. “When we begin the next CRB proceeding we will be able to actually fight for what songwriters would be paid in a free market.”

The ”MMA of 2017” will create a new entity that will establish and administer the blanket digital mechanical licensing process. It will be governed by music publishers and songwriters and represent all songwriters equally and at no cost. Importantly songwriters will, by statute, receive more than half of all unclaimed funds under the act. The new agency will begin operations in January two years after adoption of the bill.

The unmatched/unclaimed works component of the legislation allows streaming companies to avoid unnecessary litigation if they pay royalties earned by any song they stream while the new entity endeavors to find any unknown songwriters who are due payments.

It is important to note that the “Notice of Intent” (NOI) program administered by the U.S. Copyright Office will be eliminated. Tens of millions of mass NOI’s have been served on the Copyright Office since the program’s inception in the Summer of 2016, often resulting in copyright owners not being identified.

“The structure of the new administrative entity and its unmatched/unclaimed component illustrates that the music industry can provide solutions to music licensing and data issues,” adds Herbison. “We are optimistic that the process of voting on this legislation will begin soon. Streaming companies Apple, Amazon, Google, Pandora and Spotify were part of the creation of the ‘MMA of 2017.’ Going forward we all must continue to work together to solve problems in the music eco-system.”

The MMA also makes an important change to future ASCAP and BMI rate court proceedings by calling for randomly selected and rotating judges rather than judges who are presently appointed for life.

In a joint statement from NMPA President & CEO David Israelite, ASCAP CEO Elizabeth Matthews, BMI President & CEO Mike O’Neill, NSAI President Steve Bogard and SONA Executive Directors Michelle Lewis and Kay Hanley, strong support has been expressed for this new bill.

The statement reads; “We strongly support the introduction of the Music Modernization Act which represents months of collaboration and compromise between the songwriting and tech industries. This legislation enables digital music companies to find the owners of the music they use and reforms the rate setting process for performing rights, ensuring that songwriters and music publishers are paid faster and more fairly than ever before. For too long, digital music services have taken advantage of the ‘bulk NOI’ process and often failed to find the correct creators to pay, and now – by working together – this bill ends this practice by creating a private-sector system where money will no longer be lost to inefficiencies and lack of information. The bill also improves how mechanical royalty rates are calculated by introducing a willing-seller/willing-buyer standard.

“On the performance rights side, the bill also replaces the current rate court system with the random assignment of judges used in most federal court cases, and allows the rate courts to review all relevant market evidence into the valuation of how songwriters are compensated. We thank Congressmen Collins and Jeffries for their leadership in striking this balance that improves and modernizes our outdated licensing system and gives songwriters the ability to be paid what they deserve across all platforms that use music, including the growing interactive streaming services.”

UMG Becomes First Major Label/Publisher To License With Facebook, Instagram

Universal Music Group (UMG) will become the first major music company to license its recorded music and publishing catalogs for video and other social experiences across Facebook, Instagram and Oculus.

The global, multi-year agreement marks the first time, in well over a decade, that the world’s largest social media company has made such a move.

According to the release, the deal will allow Facebook users to upload videos that contain licensed music and personalize music experiences across the Facebook-0wned properties while sharing videos with friends and family. In time, functionality will expand to enable access to a vast library of music across a series of social features. The deal is also said to be intended to serve as a foundation for a strategic partnership roadmap that will deliver new music-based experiences online.

Going forward, the companies will experiment in introducing the next generation of music-based products to these Facebook platforms, including Messenger.

Canaan Smith, Lewis Brice To Join Team USA WinterFest

Mercury recording artist Canaan Smith will join Team USA athletes Allison Schmitt, Elizabeth Beisel, and Amy Purdy for Team USA WinterFest presented by HERSHEY’S in Nashville on Dec. 31. Taking place at Music City Walk of Fame Park, the interactive event includes a meet and greet with the U.S. Olympic and Paralympic athletes, a Team USA Curling Challenge, and a performance by Canaan with special guest Lewis Brice.

The event begins at 11 a.m. with Smith’s performance taking place from 3:30 – 4:30 p.m. The 13-stop festival is crisscrossing the country leading into the 2018 Olympic Winter Games, hosted in PyeongChang, South Korea Feb. 9 – 25. The WinterFest is free and open to the public.

Smith recently wrapped up his Long Way From The Freeway Tour, and just released his brand-new track “This Night Back.”

Penske Media Acquires Controlling Interest In Wenner Media

Penske Media Corporation (PMC) and Wenner Media have struck a deal, announcing Penske Media’s strategic investment in Wenner Media, majority owner of Rolling Stone.

Under the deal, Rolling Stone founder Jan Wenner will become Editorial Director, while Gus Wenner will remain President & COO and also join Penske Media’s advisory board. Wenner Media will maintain the majority control and editorial oversight for Rolling Stone. Financial terms for the investment were not disclosed.

Meanwhile, Singapore-based music start-up BandLab Technologies, which purchased a 49 percent stake in Rolling Stone in September 2016 for an undisclosed sum, continues as Wenner Media’s partner in Rolling Stone.

Rolling Stone joins Penske’s media portfolio, which includes Variety, Deadline.com, and IndieWire.

Blake Shelton Re-Ups “For Many Years” With Warner Bros./WMN

Country music superstar and multimedia entertainer Blake Shelton has inked a deal, extending his 17-year partnership with Warner Bros. / Warner Music Nashville record label.

Together, Shelton has gone on to achieve 25 No. 1 singles, 10 Gold and Platinum-selling albums, seven Grammy nominations and five CMA Male Vocalist of the Year Award wins. One of the most visible and constant ambassadors of country music, Shelton has reinforced the genre’s value in front of more than 12 million viewers two nights a week for 13 consecutive seasons and counting as a coach on NBC’s The Voice. A member of the Grand Ole Opry, Shelton served as co-host of the ACM Awards for five years.

“I remember my first trip to Nashville in 1994,” said Shelton. “I drove down Music Row and don’t know why, but when I passed the Warner Bros. building I said, ‘That’s the label I want to be on!’ Now, all these years later, I’m proud to have spent my entire recording career with such a great company. The acclaimed recording artist celebrated his re-signing Wednesday night (Dec. 20) alongside WMN Chairman & CEO John Esposito, who added: “Blake Shelton is a cornerstone artist for Warner Music Nashville. Shelton last re-upped with the label eight years ago and most recently released his 10th studio album (not including a holiday or greatest hits), Texoma Shore in 2017, which became his sixth record to debut at No. 1 on the Billboard Top Country Albums chart and 11th all-genre Top 10. With his third No. 1 single in 2017 (in addition to “A Guy With A Girl” and “Every Time I Hear That Song”), Shelton’s “I’ll Name The Dogs” made him the first artist in Country Aircheck / Mediabase history to have six songs chart simultaneously. Shelton continued traction at radio this week by being named the No.1 most-played artist of 2017, reigning on both the Billboard and Aircheck year-end airplay charts. The songs previously went No. 1 on the MusicRow CountryBreakout Chart.

Shelton will headline his 2018 Country Music Freaks Tour alongside Brett Eldredge, Carly Pearce and special guest Trace Adkins. He will again team with CID Entertainment for VIP Experiences with 2018 packages offering new perks including an autographed ‘Country Music Freaks’ Tour plaque and an exclusive BS’ers Lounge baseball cap. Lee Roy Parnell recently visited the MusicRow offices to perform songs from his latest album, Midnight Believer, which was released earlier this year on Vector Recordings/BFD. Parnell recently signed with New Frontier Touring.

Among his acoustic renditions of songs from Midnight Believer was a take on “Sunny Days,” which features harmonies from Fairfield Four.

Heidi Raye

Vocalist and songwriter Heidi Raye performed new music for MusicRow staffers, including the single “Junkyard,” which was recently added to Spotify’s New Boots playlist. Raye also performed the playfully defiant “I’m Gonna Wish You Merry Christmas.”

Blue Sky Group Promotes Chris King To Partner

Entertainment business and financial management firm Blue Sky Group (BSG) has promoted Chris King to partner. King joined the firm in 2015 as the co-head of their business management division.

The Memphis, Tennessee native is a graduate of the University of Tennessee at Martin. He began his career as an account assistance with Flood, Bumstead, McCready and McCarthy. Since pairing with Harlan Hallett in February 2015, Blue Sky Group has begun to build a roster including Grammy winners, Platinum record selling songwriters and producers and international touring artists.

“Chris’s hard work and enthusiasm, along with a commitment to our company, clients, and the entertainment industry made this choice a no brainer,” said Hallett, the president of BSG.

Lee Thomas Miller Ends Congressional Campaign

Conservative Republican congressional candidate Lee Thomas Miller has ended his campaign for Congress in Tennessee’s 7th Congressional District, approximately one month after announcing his candidacy.

Miller issued the following statement:

“I am grateful to the friends and complete strangers who have supported my run for congress. I believe that citizens have the ability and right to help shape the direction of our nation. I also think that the people know better what is good for them than does the government.

My amazing wife endorsed this massive challenge under the one condition: that I run as myself without becoming somebody I am not. These are complicated times with complicated and emotional issues. These issues affect real people’s lives. Washington has forgotten this. I looked forward to this race and the opportunity to change things that I think are broken. But as a husband and father it quickly became obvious that this campaign would require me to compromise far more of myself than I would ever be willing.

So, I will end my campaign for U.S. House of Representatives while taking with me the same desire to protect faith, family and freedom that I have always had. I will also go back to using my voice and experience to defend the American songwriter.”

The son of Kentucky tobacco farmer and a small town librarian, Miller is an award-winning songwriter who lives in Williamson County in Tennessee with his wife Jana and their four kids.

He has penned seven No. 1 songs, 12 top 10 songs and earned three Grammy nominations with artists including Trace Adkins, Garth Brooks, Brad Paisley, George Strait, Jamey Johnson and Chris Stapleton. Miller recently stepped down from his former post as president of Nashville Songwriters Association International (NSAI) in order to run for the seat.

Nashville’s Chloe Kohanski Named ‘The Voice’ Winner

Nashvillian Chloe Kohanski was named the winner for the 13th season of The Voice on Tuesday evening (Dec. 19). The 23-year-old Kohanski, who was part of Team Blake, made an impression on both viewers and the coaches by belting out classic ’80s and ’90s rock songs each week, including Bonnie Tyler’s “Total Eclipse Of The Heart,” Foreigner’s “I Want To Know What Love Is,” and Blondie’s “Call Me,” and her blind audition song, Fleetwood Mac’s “The Chain.”

During last night’s live finale, she teamed with Billy Idol to perform “White Wedding.” After being named the winner, she earned a recording contract with Universal Music Group, as well as a $100,000 grand prize.

Kohanski graduated from Donelson Christian Academy in 2012. After initially attending Cumberland University in Lebanon, Tennessee, with intentions of becoming a teacher, Kohanski dropped out and began working as a Starbucks barista in Nashville while pursuing a music career.

Kohanski’s win marks Blake Shelton’s sixth victory as a coach on the show. Kohanski beat fellow Team Shelton member Red Marlow, Team Adam Levine’s Addison Agen, and Team Miley Cyrus’ Brooke Simpson.
